Perez asks for delay on reckless homicide trial

STEVENS POINT, Wis. (WSAU) -- The man accused of shaking a two-year-old boy and throwing him to the ground might have his reckless homicide trial delayed again.

The attorney for 27-year-old Reymundo Perez has asked for more time to prepare his defense. Perez is accused of causing the death of his girlfriend’s two-year-old boy while babysitting at his home. Perez is charged with two felonies, including first-degree reckless homicide. Perez had told police that he threw the child to the ground because he wouldn’t stop crying. The boy died two days later at St. Joseph’s Hospital in Marshfield.

Attorney Gary Schmaus is waiting for an independant review of the boy's medical records. The expert appointed to the case has not been able to look over the records yet, and Schmaus wants more time for the review.

Both sides will meet in court December 20th to discuss the request. Perez is currently scheduled for a February 26th trial date.
