Social Security check fraud suspect not yet competent to stand trial

STEVENS POINT, Wis. (WSAU) --  One of the three family members accused of illegally cashing a missing family member’s social security checks is not healthy enough to stand trial.

70-year-old Dolores M Disher is accused of spending her mother Marie Jost’s checks along with her husband Ronald Disher and brother Charles Jost. Marie Jost has been missing since about 1980.

Portage County Assistant District Attorney Veronica Isherwood says Delores Disher is still quite ill. “Today, Delores Disher’s case was before the court, and she was found not competent to proceed, so there will be periodic reviews of her competency to see if the court proceedings can start up again.”

Defense attorney Stephen Sawyer offered a doctor’s report as evidence his client is not yet competent to stand trial.

Mrs. Disher is presently in a local nursing home, where her health is slowly improving.  Mr. Disher and Charles Jost are in jail awaiting an October 21st jury trial.  All three are charged with theft by false representation greater than $2,500, unauthorized use of an individual's personal document, forgery, and mail fraud.

It is still unclear what happened to Marie Jost, who if alive, would be 101 years old.
